Terms of Service

These terms apply when you use moment3d.com or order from MOMENT3D. MOMENT3D is a brand of Progress Lab Inc., an Illinois company (“we”, “us”, “the seller”). By placing an order you agree to these terms. If you do not agree, please do not order.

These are the only terms that apply to your order. Nothing you send us changes them unless we agree in writing.

You keep all rights to the photos and text you send us. You give us permission to use them, and to edit them, only to prepare, engrave and, if needed, remake your order.

By uploading a photo you confirm that:

• you own it, or you have permission from the person who does;
• the people in it would not object to it being engraved;
• it is not unlawful, hateful or sexually explicit, and does not infringe anyone’s copyright, trademark or other rights.

If someone makes a claim against us because of a photo or text you sent, you agree to cover the losses and reasonable legal costs that result.

We may decline or cancel any order and refund what you paid for it.

Every crystal is engraved for one order from the photo you provide. The preview on the site is an illustration: a designer prepares your photo by hand before engraving and may adjust it so it engraves well, so the finished crystal can differ from the preview.

We engrave text exactly as you type it. Please check spelling, names and dates before ordering.

If a photo will not engrave well, we will email you before making anything. Production starts when we have a photo that will work, and the delivery estimate moves with it.

Prices are in U.S. dollars and can change without notice; the price that applies is the one shown when you order. Prices do not include sales tax. Where the law requires us to collect it, tax is added at checkout and shown before you pay.

Payment is taken in full when you place the order, through our payment provider. You confirm that you are allowed to use the payment method you choose.

If a price on the site is shown in error, we will contact you before making the order and you may cancel for a full refund.

Offers and promo codes apply only as described with each offer. They cannot be exchanged for cash and we may end them at any time.

We usually make an order in 1–2 business days after the photo check and ship within the United States. Shipping is free on orders of $79 or more; other options and their prices are shown at checkout.

Delivery dates are estimates. Carriers can be late, especially before holidays, and we are not liable for carrier delays.

If tracking shows the order as delivered and you do not have it, or it has not arrived by its delivery date, tell us within 48 hours of that date. We will try to locate it and, where we can, remake it.

Write to us as soon as possible and tell us why. We can change or cancel an order until production starts. If the order is made, partly made or ready to ship, changes and cancellations may no longer be possible.

You may return your order for any reason within 30 days of delivery:

• in its original packaging and in the condition you received it;
• with your order email or another proof of purchase inside;
• sent prepaid to Progress Lab Inc., 116 Somerset Dr, Streamwood, IL 60107. Return shipping is paid by you, and the parcel is your responsibility until it reaches us.

We refund the price of the returned items to your original payment method. Shipping you paid for the order, including fees for faster shipping, is not refunded. An item that is not in its original condition may be refunded in part.

If the crystal arrives damaged, email us within 48 hours of delivery with photos of the crystal, the box and the packing material. We will decide how to put it right, usually by making a new one at no cost.

Because every piece is made to order, we remake a crystal only when something is wrong with it. Edits our designers make to a photo so that it engraves well are not a defect.

After 30 days from delivery we cannot offer a remake or a refund. Details and the request form are on the Returns & remakes page.

We warrant that your order is free from defects in material and workmanship when it is delivered. This is our only warranty. To the extent the law allows, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Items we sell but do not make, such as light bases, carry the warranty of their manufacturer, if any.

To the extent the law allows, our total liability for any order is limited to the amount you paid for it, and we are not liable for incidental, indirect, special, punitive or consequential losses, whatever the legal basis of the claim. Nothing in these terms limits rights that cannot be limited by law.

The site, its design, text and images belong to us or our licensors. Product images are illustrative. You may not copy the site, interfere with how it works, or use it to build a competing service.

Reviews, photos and videos you submit for publication may be shown on the site and in our marketing. Only send us content you have the right to share.

These terms and any dispute about them or about an order are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Disputes will be heard only in the state or federal courts located in Cook County, Illinois.

To the extent the law allows, you and we each waive the right to a jury trial, and you agree to bring claims only on your own behalf and not as part of a class or representative action.

We are not liable for delay or failure caused by events beyond our reasonable control. If we do not enforce a part of these terms, that is not a waiver of it. If a part of these terms cannot be enforced, the rest still applies.

We may update these terms; the version posted here when you order is the one that applies to that order.
